Celestys — Terms and Conditions of Use

Welcome to Celestys. These Terms and Conditions of Use ("Terms") form a binding agreement between you ("you" or "User") and Verde Fish Entertainment SRL, registered at Bd. Mareșal Alexandru Averescu nr. 7, Sector 1, Bucharest, Romania ("Celestys," "we," "us"), governing your access to and use of the Celestys mobile application, including its SkinAI, NailsAI, and SuperBodyAI modules (the "App" or "Services").

By creating an account or using the App, you confirm that you have read, understood, and agree to be bound by these Terms, our [Privacy Policy], and our [Disclaimer]. If you do not agree, do not use the App.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country of residence, or 18 where required by applicable app store age rating) to create an account and use the App. By using the App, you represent that you meet this requirement and that all information you provide is accurate.

2. Description of the Services

Celestys is a wellness and lifestyle mobile application designed for women, offering: - SkinAI — AI-based visual analysis of skin condition and skincare recommendations - NailsAI — AI-based visual analysis of nail condition - SuperBodyAI — combined body-composition analysis (via user-submitted photographs), meal/nutrition photo logging, and a personalized report combining calorie/macro estimates (using standard formulas such as Mifflin-St Jeor) with AI-generated qualitative recommendations tailored to a goal you select (e.g., weight loss, muscle gain, maintenance, definition, sports performance, general health, recovery, post-pregnancy, active seniors, plant-based) - Cycle Calendar — menstrual cycle tracking and predictive estimates based on dates you log - Grounding, Frequencies, and Self-Knowing — reflective wellness content, including audio tones/frequencies and self-reflection material - Supplement & vitamin recommendations — editorial content suggesting supplements/vitamins that may suit your profile or goals. We do not sell these products or process any related payment; recommendations are informational only, and any decision to purchase a product elsewhere is entirely yours.

These features are provided for general wellness, informational, and lifestyle purposes only. They are not medical devices and do not provide medical diagnosis, treatment, or advice. Cycle predictions are estimates and must not be relied upon as a method of contraception or fertility planning. Grounding and Frequencies content reflects complementary/wellness practices without established clinical proof of medical effect. 3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must provide accurate registration information (name, email) and keep it up to date.
You may delete your account at any time from within the App; this will trigger deletion of your associated data as described in our Privacy Policy.
We may suspend or terminate accounts that violate these Terms, applicable law, or that we reasonably believe pose a security or integrity risk to the Services.

4. User-Submitted Content (Photographs)

You retain ownership of any photographs you upload (face, body, nails, meals) ("User Content").
By submitting User Content, you grant us a limited, non-exclusive, worldwide license to process, store, and transmit that content solely for the purpose of providing the requested AI analysis and generating your personalized results, in accordance with our Privacy Policy.
We do not use your User Content for advertising, and we do not sell it to third parties.
You confirm that any photograph you submit depicts you (the account holder) or, where meal photos are concerned, food that you have prepared or intend to consume, and that you have the right to submit it. Do not upload photographs of any third party (including other people) without their consent.
You may delete individual pieces of User Content at any time via the App.

5. Acceptable Use

You agree not to: - Use the App for any unlawful purpose or in violation of these Terms; - Upload content that is unlawful, infringing, obscene, or that depicts individuals without their consent; - Attempt to reverse-engineer, decompile, or extract source code or AI models underlying the App; - Interfere with, disrupt, or attempt unauthorized access to our servers, Firebase infrastructure, or Cloud Functions; - Use automated means (bots, scrapers) to access the Services; - Misrepresent your identity or age.

Violation of this section may result in immediate suspension or termination of your account.

6. Supplement & Vitamin Recommendations

Supplement and vitamin content within the App is editorial and informational. We are not a retailer of these products, we do not process payments for them within the App, and we do not guarantee their availability, price, or efficacy from any third-party seller you may separately choose to purchase from.
Recommendations do not constitute an endorsement of any specific brand's safety or effectiveness, and are not a substitute for advice from a doctor or pharmacist, particularly if you are pregnant, breastfeeding, on medication, or managing a medical condition.
If in the future the App includes affiliate links to third-party retailers, we will clearly label such links as such, and your purchase will be governed entirely by that retailer's own terms — we are not a party to that transaction.

7. Subscriptions & Payments (if applicable)

[If Celestys offers paid subscriptions or in-app purchases:] Payments are processed exclusively through the Apple App Store or Google Play Store billing systems, subject to their respective terms. Prices, free trials, renewal terms, and cancellation policies are as displayed at the point of purchase within the applicable app store. We do not directly process or store your payment card information.

8. Intellectual Property

The App, including its design, software, AI-generated report formats, logos, and the "Celestys" name and branding, is owned by Verde Fish Entertainment SRL and protected by intellectual property laws. Except for the limited license to use the App for personal, non-commercial purposes, no rights are granted to you in our intellectual property.

9. Third-Party Services

The App relies on third-party infrastructure and AI services, including Google Firebase (hosting, authentication, database) and Anthropic's Claude API (AI-based photo and text analysis). Your use of the App is also subject to the availability and performance of these third-party services, which are outside our direct control.

10. Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to accuracy, completeness, or fitness for a particular purpose.
AI-generated analysis (skin, nail, body, nutrition) is probabilistic and for general informational/wellness purposes only; it is not a substitute for professional medical, dermatological, nutritional, or fitness advice. See our full [Disclaimer].
To the maximum extent permitted by applicable law, Verde Fish Entertainment SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use the App.
Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g., liability for death or personal injury caused by negligence, or fraud).

11. Indemnification

You agree to indemnify and hold harmless Verde Fish Entertainment SRL from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.

12. Modifications to the Services or Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may update these Terms from time to time; material changes will be communicated via in-app notice or email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the App and delete your account at any time.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of [COUNTRY OF INCORPORATION, e.g., Romania], without regard to conflict-of-law principles, except that if you are a consumer resident in the EU/EEA or UK, you retain the benefit of any mandatory consumer-protection provisions of your country of residence. Any dispute shall be submitted to the competent courts of Bucharest, Romania, unless mandatory consumer protection law grants you the right to bring proceedings in your own country of residence.

15. App Store Terms

Your use of the App is also subject to the standard end-user license terms and policies of the platform through which you downloaded the App (Apple App Store or Google Play Store). In case of conflict between these Terms and the applicable platform's mandatory terms, the platform's terms apply solely with respect to platform-level matters (e.g., billing, refunds).
